An ITV Wales investigation has revealed the true challenge facing our adoption services across Wales.

And with the number of children in foster care, homes and other servies soaring to a record high, the figures we’ve uncovered make grim reading

There are currently five thousand children who are in care in Wales. Many of those are not suitable for adoption, but of those that are only 200 complete the process each year

The average time for an adoption is just over two-and-a-half years.

David Wood has been listening to the story of one family who’ve tried to make a difference.

It appears that foreigners are particularly targeted by Social Services. One such story appeared in The Telegraph recently: A mother on a visit to the UK loses her three children to social services – a particularly disturbing case emerges, as the media wake up to the soaring numbers of children being taken into ‘care’.

No wonder Anonymous vs Social Services organises a demo in Haringey Council on Saturday 3rd March and One Voice for the Kids a world wide Peaceful Protest against Child Abuse on Tuesday 6th March.

I was most interested to read about your willingness to criticise the Judiciary in the Maldives for being ‘corrupt and hostile’. Might we therefore count on you supporting our criticisms in the UK, by asking the Minister of Justice how he expects corruption and hostility towards victims of white collar crimes to go away here, in the UK?

Here’s the evidence we’ve collected so far:

• Victims Unite has published some 30 individual cases and has had over 85,000 visitors since August 2010
• Reporting of Fraud – EDM 516 in 2010 – illustrates the beginning of the problem: reporting is too complicated, but actually not worth it, because fraud is not being investigated
• The Forensics of Legal Fraud: Volume 1 and Volume 2 analyse and present two really horrific cases of corruption in detail
• four fraudulent key sample cases were put before the Minister of Justice and the Business Minister without any effect or result
• Complaint procedures are simply designed to fob off and never achieve anything.

Furthermore, you may want to take note of the following petitions and, above all, their comments:

• The Secrecy of the Family Courts should be lifted NOW, published on May 20, 2011, with over 800 signatures and > 12,000 page views and remarkable comments
• Parliamentary Inquiry into White Collar Crimes with > 100 signatures, > 3,000 page views and fascinating remarks since April 16, 2011
• WANTED: Fair Trials and Compensation with > 7,500 page views, 400 signatures and these most interesting comments (since November 2010)

March 6th has been chosen for a day of world wide protest against child abuse, where the Family Courts are certainly hostile, whereas the corruption seems to lie with Social Services who seem to dictate what happens in courts.

So far, I called them ‘victims turned starfighters’ and they will all have acted as McKenzie Friend in that learning process.

Now Belinda McKenzie (!)  came up with the idea of an Association of McKenzie Friends to give ‘public interest advocacy’ more clout and presence in the legal process.

Maurice Kirk experiences the loopholes in the law in prison as a litigant in person. The Musas have been criminalised by Haringey Council after they kidnapaped their six children and have very similar experiences in prison:

• not being ‘produced’ by the prison staff for court hearings
• not being able to meet court deadlines when McKenzie Friends are not allowed legal visits to take documents in and out of prison
• not being able to type and photocopy documents.

Trying to help parents whose children have been snatched is made more difficult, as ‘the other side’ consists of Social Services and CAFCASS in addition to a labyrinth of family court procedures.

But McKenzie Friends are learning by doing. We shall use the world wide Peaceful Protest against child abuse on Tuesday 6th March as the opportunity for joining forces and bring McKenzies to Westminster. Watch this space, click to follow this blog and stay tuned!

Not by a General Social Care Council, as The Times editor Camilla Cavendish recommended in 2009, but by OFSTED, the Office for Standards, in Education, Children’s Services and Skills, whose job it is to determine ratings for local councils.

May the fear of inspection instill some sense into Social Services!

Already I have managed to scare one of their outfits such that they ‘threaten’ to return three children, if only the parents agree not to have contact with me or three other helpers! A “conditional” victory!…

Camilla Cavendish[1] is Associate Editor and columnist at The Times. In 2009, she was campaigning journalist of the year for exposing miscarriages of justice which convinced Government to open the family courts – but not enough. Here is her 10-point plan that is waiting to be implemented:

1. Open family courts to the press in all but exceptional circumstances (as recommended by the Constitutional Affairs Select Committee)
2. Let any parent or carer accused of abuse call any witnesses they need in their defence. At the moment, they are routinely refused permission to do so.
3. Give automatic permission for parents who are refused legal aid to get a lay advisor to help them present their case. This is routinely refused.
4. Remove the restrictions that prevent families from talking about their case (as recommended by the Constitutional Affairs Select Committee).
5. Review the definition of “emotional abuse” across local authorities, to make sure that it cannot become a catch-all for overzealous officials.
6. Provide an automatic right for parents to receive copies of case conference notes and all evidence used against them in court, just as they would in a criminal trial.
7. Create an independent body to oversee the actions of social services, with proper sanctions. If that body is to be the General Social Care Council, make it easier for parents to go directly to that body rather than having to face delays from the local authority.
8. Let children in care waive their right to privacy, if they wish to speak out. For gagging children is surely not consistent with promoting their welfare.
9. Restructure CAFCASS, the Family Court Advisory Service, from being an organisation that reports on the parents to the courts to one that actively promotes the parenting needs of children. The primary focus should cease to be assisting the court process. It should be diverting parents away from contested hearings into the making of parenting plans.
10. Review the recent legal aid cutbacks that are deterring lawyers from taking on these complex family cases. It is quite wrong that desperate parents are unable to find a lawyer to help them in their time of need.

In the darkness of secrecy, sinister interest and evil in every shape, have full swing. Only in proportion as publicity has place can any of the checks, applicable to judicial injustice, operate. Where there is no publicity there is no justice.”
