US MOTHER to be deported whilst her child is kept for adoption

13 08 23 eighteen and underThe US mother of a single child is one of some 50 foreign nationals kept in Holloway, whilst their children are in ‘care’. Her judgement to ‘discharge’ the stay on her deportation is on John Hemming MP’s blog.

Two ‘reconsiderations’ of this and another refusal are before the Court that says a hearing will take place within 8 weeks.

The barrister who submitted the Judicial Review that caused the published judgement wrote that UKBA knows every second that she is being held is illegal. For 14 months are beyond EU rules of 6 months and ‘excessive’ rather than ‘reasonable’ in terms of UK laws.

What can she do? Submit another application. From prison conditions that are made to prevent her from access to justice: no money for phone calls and mail delayed, besides McKenzie Friends not being allowed to take papers in and out. Only solicitors. Two law firms advised her badly. One suggested she should change her non-guilty plea to ‘guilty’.

But Edward Timpson MP in his response to Belinda McKenzie’s letter to the Prime Minister to RETURN OUR STOLEN CHILDREN writes:

… placing a child in the care of a local authority, the authority will continue to work with the family with a view to the child returning home

We only know what we’re up against when we’re in it and directly hit and concerned:

  • the systematic destruction of the family unit
  • the endemic hypocrisy “in the best interest of the child”
  • the Rule of Money over the Rule of Law
  • the political apathy towards the financial war
  • the ‘austerity cuts’ that create extra havoc in a corrupt judicial system
  • ‘globalisation’ as the policy for blurring national identification and sovereignty.

    1) Although they won’t admit to it, nearly all leave for JR not submitted by a solicitor appear to be refused.

    2) During the holiday period, lower Judges are made up, ie. given the power of a High Court judge, to sit at people’s cases as guinea pigs, to see if the Judge is worth promoting in the future. This was one such judge, the clue is in “sitting as”!

    3) It was only a decision on paper. Whoever is representing the US woman, I presume completed the form within 3 days and asked for an oral hearing, which is I presume:

    “Two ‘reconsiderations’ of this and another refusal are before the Court that says a hearing will take place within 8 weeks.”

    4) I don’t know the full details of the case, but at the oral hearing the skeleton argument put in before hand should plead the illegality properly, to be followed up with the oral arguments on the day. You have to realise that nearly all judgements in the RCJ appear to be written out before the hearing has even taken place, ie fiddled. So the person representing needs to make sure the Judge deals with ALL the relevant points.

      1) The first SUPERB submission by a public law barrister was even refused! I’m picking up where he left off his pro bono contribution, as he’s too busy with a major case in court. But THANKS for your observation as a warning!

      2) “Sitting in” – what a key clue! Someone else commented negatively on the level of the judge.

      3) Yes, decision on paper. The ‘reconsideration’ or Notice of Renewal apparently automatically implies an oral hearing.

      4) Nobody CAN know the full details of her case, as a box of legal documents was stolen by HMP Holloway instead of being handed over to her McKenzie Friends. It magically re-appeared on 19 August and I shall scrutinise it after my holidays. I concentrate on the written materials, while another Super McKenzie will do the court presentation, hopefully. To cover ALL the relevant points is the challenge of the day. For one cat comes out of the bag after another in this horrendous sequence of ‘legal fraud’.

      I think I’ll owe it to myself and Melissa to let this become “Volume 3 of the Forensics of Legal Fraud” – after Mr Ebert and dear Paulett Cooper RIP. Let’s hope we end up making history such that future generations will suffer less from institutionalised ‘deny and lie’, ‘commit more crimes to cover up crimes’ and generally ‘shifting the blame’!
